Desi justitia este independenta, in Romania inca nu s-a explicat ce insemna aceasta independenta: se refera doar la actul de justitie, adica la deciziile luate in solutionarea unui caz concret? se refera doar la judecatori, sau si la procurori si chiar la politia judiciara? priveste numai functionarea sau si organizarea structurilor care infaptuiesc dreptatea? daca priveste si organizarea, atunci se refera doar la activitatile judiciare sau si la cele administrative si cele finaciare?
Personal, din 2003 studiez standardele internationale privind cei trei `i`: independenta, impartialitatea si integritatea justitiei. In anul 2006 am publicat, alaturi de alti doi judecatori, un Ghid in al carui capitol II explic acesti termeni. Daca unele aspecte sunt acoperite si de legislatia noastra, in unele suntem profund deficitari.
Unul dintre acestea este modul de finantare a instantelor judecatoresti. Astfel, desi procurorii sunt constitutional sub autoritatea ministrului justitiei, totusi parchetele au buget distinct; pe cand judecatorii sunt declarati independenti dar bugetul instantelor este gestionat de ministrul justitiei. Dezastrul financiar la care s-a ajuns ca urmare a politicii bugetare inadecvate, controlul politic al bugetului instantelor, lipsa unei politici de salarizare adecvata au adus sistemul de instante acum, in anul 2009, la un colaps.

Acesta este motivul pentru care impreuna cu alti colegi am initiat in ultimele doua saptamani, alaturi de asociatiile profesionale, actiuni civice prin care sa atragem atentia asupra pericilitarii statului de drept daca justitia nu poate functiona in conditiile in care organizarea acesteia inregistreaza deficiente majore. Aceste actiuni au fost legitimate de CSM care a convocat in saptamana care urmeaza adunarile generale ale tuturor instantelor si parchetelor pentru a se pronunta pe textul unei Rezolutii. Desi forma trimisa de la CSM se refera si la parchete, atunci cand am initiat aceasta rezolutie, ne-am gandit doar la declararea independentei administrative si financiare a instantelor judecatoresti care ele singure sunt cuprinse in sintagma `putere judecatoreasca`. Demersul procurorilor vine insa sa intareasca actiunea noastra spre auto-guvernare.
Pentru a explica de ce este nevoie de o asemenea Rezolutie noi, initiatorii, am conceput si un document white paper, pe care l-am trimis instantelor, facilitand astfel intelegerea importantei acestei declaratii. Desigur, ne-am gandit si la pasii urmatori, care inseamna si alte chestiuni concrete pentru puterea in practica a ceea ce ne dorim: trecerea bugetului instantelor de la MJLC la ICCJ, finantarea justitei cu minimum 1% din PIB, trecerea sumelor obtinute din taxele de timbru de la bugetele locale inapoi la justitie, eliminarea atributiilor CSM care nu au legatura cu cariera magistratilor, recunoasterea de catre orice autoritate si asumarea de catre celelalte puteri a statutului de putere publica a justitiei.
